Ethical Cloud and AI Vendor Selection for Criminal Defenders: A NACDL CLE
The session gave criminal defense lawyers a framework for evaluating AI and cloud vendors before adoption, covering three core areas:
- Protecting client confidentiality and attorney-client privilege
- Vetting vendor contracts for data retention, subprocessor risks, and conflict of interest clauses
- Meeting ethical obligations under rules governing competence, confidentiality, and supervision of non-lawyer assistants
Jeff also walked through concrete tools like vendor scorecards, checklists, and model contract language to help defenders identify hidden risks and ask the right questions before clicking accept on any new tool.
